All terms used in this section have the meaning as defined by the applicable Personal Data Protection Act and the General Data Protection Regulation (GDPR).

Golden Tree d. o. o. (hereinafter: the Company) processes personal data within the scope of the services it provides. The Company undertakes to protect the confidentiality of personal data and the privacy of users of its services by implementing appropriate organisational and technical measures.

The Company is not responsible for the accuracy, completeness, or timeliness of the data entered by users. The Company does not disclose personal data to third parties, except to contractual processors with whom it has concluded a data processing agreement and who are contractually bound to comply with the same personal data protection standards as the Company.

The Company stores personal data within the territory of the European Union and does not transfer such data to third countries.

Purpose of processing

Personal data obtained through websites managed by the Company for the purpose of completing an online purchase or fulfilling obligations arising from a concluded subscription are used exclusively for the processing and delivery of orders. In the case of participation in a loyalty programme, purchase data is processed on the basis of the individual’s consent.

For certain services (such as receiving regular notifications from the Company or other promotional activities), the Company collects personal data on the basis of the individual’s explicit consent. The individual may withdraw their consent at any time in accordance with these Terms and Conditions.

By consenting to the storage, processing, and transfer of personal data through participation in prize draws, subscription to email newsletters, or by giving consent when purchasing a product or service, the individual authorises the Company, as the controller of personal data, to process the collected personal data for the purposes of sampling, surveys, and statistical analysis, determining service usage, adapting offers and segmentation, market research, informing individuals about offers, news, and benefits, sending notifications via email, telephone, and/or other promotional materials, and informing users about the services of the online platform, Golden Tree d. o. o., and related entities.

Retention period

Where personal data is processed on the basis of consent, such data is processed until the consent is withdrawn by submitting a request for deletion from the database.

Where personal data is processed on another legal basis (e.g. performance of a sales contract or compliance with legal obligations), the Company retains the personal data for as long as necessary to achieve the purpose for which the data was collected, or for as long as required by applicable legislation. 

Exercising individual rights

For the purpose of reliable identification when exercising rights relating to personal data, the Company may request additional information from the individual. The Company may refuse to act on a request only if it can demonstrate that it is unable to reliably identify the individual.

The Company undertakes to respond to a request to exercise any of the rights listed below within 30 days. If the request cannot be fully fulfilled within this period, the Company will inform the individual accordingly, together with an explanation.

Right to information

You have the right to obtain information on which of your personal data is being processed, the legal basis for processing, the purpose of processing, and the retention period.

Right to erasure (“right to be forgotten”)

If you no longer wish for your personal data to be processed by the Company, and provided there are no other lawful grounds for its continued processing, you may request the deletion of your personal data at any time.

Right to rectification, erasure, or to lodge a complaint

You may request the rectification or deletion of your personal data at any time using the contact details provided in this section, and you may lodge a complaint regarding the processing of your personal data by the Company.

You may unsubscribe from email notifications at any time by contacting info@gogoldentree.health or by clicking the “Unsubscribe” link at the bottom of promotional emails.

To unsubscribe from occasional promotional SMS messages, please click the link provided at the bottom of the SMS message. You will be redirected to a website where you can enter the phone number for which you no longer wish to receive promotional messages. After entering the number, click the “Unsubscribe” button and your number will be removed from the messaging database.

Registered users may stop using the online store at any time and cancel their registration by submitting a written notice of cancellation. Before cancelling registration, the user must settle all outstanding obligations arising from purchases made in the online store. The Company will continue to protect the confidentiality of personal data and the privacy of users in accordance with this Privacy Policy even after registration is cancelled.

Right to data portability

An individual has the right to receive personal data relating to them, which they have provided to the controller, in a structured, commonly used, and machine-readable format.

Right to legal remedy

An individual has the right to lodge a complaint with the supervisory authority (the Information Commissioner of the Republic of Slovenia), as well as the right to seek legal remedies against a decision of the supervisory authority or in the event of its inaction. In any case, we encourage you to first contact the Company using the contact details above.

Rights relating to automated processing

An individual has the right not to be subject to decisions based solely on automated processing, including profiling. In such cases, the individual may submit a complaint using the contact details above.

Right to withdraw consent

An individual has the right to withdraw consent to the processing of personal data at any time where such processing is based on consent (e.g. for receiving promotional communications).
